1. Acknowledgment and Acceptance of Terms

These Terms of Service ("Terms") dictate the legally binding parameters governing your access to and deployment of the digital infrastructure, enterprise networks, and public interfaces operated by OrbitHelm Inc. ("OrbitHelm", "we", "our"). By connecting to our network, accessing our data repositories (including orbithelm.com and ir.orbithelm.com), or utilizing any of our digital services, you acknowledge that you have read, comprehended, and unconditionally agreed to be bound by these Terms. If you do not agree to these stipulations, you are legally mandated to disconnect from our infrastructure immediately.

2. Intellectual Property and Asset Sovereignty

All digital assets, conceptual frameworks, and data hosted on this infrastructure are the exclusive, sovereign intellectual property of OrbitHelm Inc. This includes, but is not limited to:

  • Proprietary Technology: Aerospace engineering schematics, artificial intelligence (AI) neural network architectures, defense system specifications, and enterprise software source code.
  • Brand Assets: Trademarks, service marks, logos, typography, visual design languages, and the "OrbitHelm" nomenclature.
  • Content: All text, graphics, audio-visual telemetry, and data compilations.

Unauthorized extraction, reverse-engineering, decompilation, reproduction, or commercial deployment of any OrbitHelm intellectual property is strictly prohibited and constitutes grounds for immediate civil litigation and criminal prosecution under international copyright and patent laws.

3. Prohibited Operations and Network Abuse

As a user of this infrastructure, you are expressly prohibited from engaging in the following operations:

  • Deploying automated extraction algorithms (spiders, scrapers, bots) to harvest proprietary data, telemetry, or user information.
  • Attempting to bypass Zero-Trust Network protocols, probing for vulnerabilities, or initiating cyber kinetic operations (e.g., DDoS, SQL injection, cross-site scripting) against our servers.
  • Transmitting or uploading malicious code, ransomware, or any software designed to disrupt, damage, or gain unauthorized access to OrbitHelm networks.
  • Falsifying digital signatures, headers, or IP addresses to mask your origin or masquerade as an authorized OrbitHelm operative or government entity.

5. Defense & Export Control Compliance (ITAR / EAR)

OrbitHelm operates within highly regulated defense and aerospace sectors. By accessing our platform, you certify that you are not located in, under the control of, or a national/resident of any country subject to comprehensive international embargoes or sanctions. Furthermore, the transmission of technical data pertaining to military technologies, aerospace telemetry, or advanced AI architectures may be strictly regulated by the International Traffic in Arms Regulations (ITAR) and the Export Administration Regulations (EAR). Unauthorized export or dissemination of such restricted data is a federal offense.

6. Limitation of Liability and "As-Is" Provision

The digital infrastructure and all embedded information are provided on an "AS IS" and "AS AVAILABLE" basis. OrbitHelm Inc. expressly disclaims all warranties, whether implied or statutory, including warranties of merchantability, fitness for a specific operational parameter, and non-infringement.

Under no circumstances shall OrbitHelm Inc., its board of directors, subsidiaries, or engineering personnel be held liable for any direct, indirect, incidental, kinetic, or consequential damages (including loss of data, loss of capital, or system failure) arising from your use of, or inability to securely access, our network.

7. Infrastructure Termination Rights

OrbitHelm reserves the unilateral right to terminate, restrict, or throttle your access to our infrastructure at any time, without prior notification, if we detect anomalous behavior, violations of these Terms, or threats to our operational security posture.

8. Governing Law and Dispute Resolution

These Terms, and any disputes arising from your interaction with OrbitHelm Inc., shall be governed by and construed in accordance with established international corporate law and the local laws of our global headquarters' jurisdiction, bypassing conflict of law principles. Any legal action or arbitration must be filed within one (1) year after the cause of action arises, otherwise, such cause is permanently barred.
